Terms of Service

Welcome to MaaSphere. These Terms of Service ('Terms') govern your access to and use of the MaaSphere mobile application, website (https://maasphere.in), and related services (together, 'the App'), provided by Elegance Professional ('MaaSphere', 'we', 'our', or 'us').

By creating an account or using MaaSphere, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, please do not use the App.

1. Eligibility

You must be legally permitted to enter into these Terms under applicable law to use MaaSphere. MaaSphere is not directed at children, and by using the App you confirm that you meet the minimum age required by the law of your jurisdiction to use a service of this kind.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Please notify us promptly at support@maasphere.in if you suspect unauthorized use of your account. You agree to provide accurate information when creating and maintaining your account.

3. Medical Disclaimer

MaaSphere is an informational and organizational tool for pregnancy and early parenthood. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment. Content in the App — including weekly baby-development information, educational articles, guidance, and tracking tools (such as the Kick Counter) — is general in nature and is not a substitute for the individualized advice of your doctor, midwife, or other qualified healthcare provider. Always consult a qualified healthcare professional with any questions about your pregnancy, your health, or your baby's health, and before making any medical decision. If you believe you are experiencing a medical emergency, contact your local emergency services immediately — do not rely on the App. A full Medical Disclaimer is available at all times from Settings > Medical Disclaimer.

4. AI Disclaimer

MaaSphere includes an AI-powered assistant ('Dhruv AI'), built using third-party AI models provided by Anthropic. Dhruv AI is a software tool, not a healthcare professional. Its responses are generated automatically, may be incomplete or inaccurate, and must never be relied on as medical advice or as a replacement for professional care. You are solely responsible for verifying any information from Dhruv AI with a qualified healthcare provider before acting on it. 5. Acceptable Use

You agree not to: use the App for any unlawful purpose; attempt to gain unauthorized access to the App, other users' accounts, or our systems; interfere with or disrupt the App's operation; upload content that is unlawful, harassing, or infringes another person's rights; or misuse the Dhruv AI Assistant to generate content unrelated to its intended pregnancy/maternal-health purpose or to attempt to bypass its safety features.

6. User Content

You retain ownership of the information and content you submit to MaaSphere (such as pregnancy details, symptoms, photos, or notes). By submitting content, you grant us a limited license to store, process, and display that content back to you, and to your connected doctor or partner where you have chosen to share it, solely to provide the App's features. 7. Doctor and Partner Connections

If you choose to connect a partner or a doctor to your account, you control what categories of information are shared with them through the App's permission settings, and you may revoke that access at any time. Doctors using MaaSphere's doctor-facing features are independently responsible for their own professional conduct and clinical judgment; MaaSphere does not supervise or guarantee the advice of any doctor using the platform.

8. Subscriptions and Payments

MaaSphere does not currently offer paid subscriptions or in-app purchases. If we introduce subscription or paid features in the future, we will update these Terms to describe pricing, billing, renewal, and cancellation terms before any such feature becomes available, and where required by Apple's or Google's platform policies, such purchases will be processed through the applicable app store's in-app purchase system.

9. Intellectual Property

The App, including its design, branding, logos, and underlying software, is owned by MaaSphere/Elegance Professional and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer the App except as permitted by applicable law.

10. Third-Party Services

The App relies on third-party service providers (including Supabase for hosting/authentication, Anthropic for AI processing, and Sentry for crash reporting) as described in our Privacy Policy. We are not responsible for the availability or performance of these third-party services.

11. Termination

We may suspend or terminate your access to the App if you violate these Terms, misuse the App, or as required by law. You may stop using the App and delete your account at any time via Settings > Delete Account, as described in our Privacy Policy.

12. Disclaimer of Warranties

The App is provided 'as is' and 'as available,' without warranties of any kind, express or implied, to the maximum extent permitted by applicable law. We do not warrant that the App will be uninterrupted, error-free, or that AI-generated content will be accurate or complete.

13. Limitation of Liability

To the maximum extent permitted by applicable law, MaaSphere and Elegance Professional shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the App, including reliance on any content, AI-generated response, or third-party service. Nothing in these Terms limits liability that cannot be limited under applicable law.

14. Indemnification

You agree to indemnify and hold harmless MaaSphere and Elegance Professional from any claims, damages, or expenses arising from your misuse of the App or violation of these Terms, to the extent permitted by applicable law.

15. Governing Law and Disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles, except where applicable local law requires otherwise for a given user. Any dispute arising from these Terms or your use of the App will first be attempted to be resolved informally by contacting support@maasphere.in.

16. Changes to These Terms

We may update these Terms from time to time. When material changes are made, we will revise the 'Last Updated' date and, where appropriate, notify users through the App, website, or other reasonable means. Continued use of MaaSphere after updates constitutes acceptance of the revised Terms, unless otherwise required by law.
